16 Year-Old Girl On 'Vampire Website' Gets Caught Up In 12 Year-Old's Murder Trial

Johnathan Mistrial: Judge Says Post Story Casts Doubt On Witness

Toronto, Canada - The judge in the Johnathan murder trial declared a mistrial last night after information reported in yesterday's National Post led the court to conclude the Crown's marquee witness might have perjured herself.

"As a result of some information that has just come to my attention, that a principal prosecution witness may have given misleading testimony, evidence that formed a significant part of the impeachment of a principal defence witness -- evidence, I might advise, that was unknown to any of the counsel conducting the case, prosecuting or defending -- I have decided to declare a mistrial," Mr. Justice David Watt said.

As he spoke, Johnathan's mother, who is also the mother of one of the accused, started to cry, and Johnathan's stepfather began to cry and rushed from the courtroom.

Jonathan's older brother and two of the brother's friends are charged with first-degree murder in the November, 2003, stabbing death of the 12-year-old boy in his east-end Toronto home. The accused, all teenagers, cannot be identified.

The defence argued the older brother, who was 16 at the time, stabbed Johnathan in a spontaneous rage, and said the other two accused were not involved.

The brother and one of his friends are also charged with attempting to murder Johnathan's stepfather by ambushing him with a baseball bat when he arrived home. The third accused had fled by then.

The Crown said all three accused had planned the bloody murders, as evidenced by a telephone call made on the day of the violence in which one of the accused discussed their intentions with his girlfriend -- now the key Crown witness.

Before addressing the jury last night, Judge Watt told court: "I don't see in this case how Humpty can be put back together again. If this young woman did not commit perjury, she came close enough ... and I don't see what else I can realistically do."

At issue were postings the 16-year-old girl made on a Web site for vampire enthusiasts in which she appeared to express a fondness for blood, pain, knives and cemeteries.

Defence lawyers said yesterday the Internet writings were central to the murder trial since one of the key pieces of evidence -- a recorded telephone call made to the witness on the day of Johnathan's death in which the accused boasted of a plan to kill the boy and his family -- could have simply been the musings of one vampire enthusiast to another.

The witness testified she thought the accused's blood fetish was childish. She had been his girlfriend for only a few weeks at the time.

Speaking about the vampire Web site, defence lawyer David McCaskill said yesterday, "This seems to be some sort of chatroom ... she includes among her 'likes' blood, pain, cemeteries and darkness ... there may well have been semi-nude photographs."

He noted the witness had described the accused's blood fetish as childish and said "what she has posted puts the lie to that."

A National Post story that reported the existence of the girl's entries on the vampire Web site was filed with the court yesterday, as were printouts from the site. The witness's page on the site was removed last spring, but "cached" versions could still be found on the Internet by typing the girl's Internet nickname into a search engine.

Mr. McCaskill said his client, the vampire enthusiast, "thought he had found a kindred spirit in her," but in court the prosecution made that look absurd. Mr. McCaskill said the witness had perjured herself.

Defence lawyer Dennis Lenzin said the witness's credibility is in doubt. He said the central issue in the case "was whether those phone calls are one vampire talking to another vampire ... or whether it was a serious plan [to kill]."

Prosecutor Hank Goody said before the judge ruled that a mistrial would be a "Draconian remedy" and asked that the jury be allowed to continue.

Outside the court, the father of the ex-boyfriend said he was glad his son "was going to get another opportunity to show that what he was saying was the truth."

The biological father of Johnathan and his brother said the Web site "brought the truth out, that she lied." He said he agreed with defence assertions that the murder was not planned.

The Crown and defence are to meet on Friday to decide how to proceed.


What She Posted On The Website

On a Web site for vampire enthusiasts, the 16-year-old girl who was the Crown's key witness appears to suggest she shared some of the bloodlust to which her ex-boyfriend admitted -- and which she dismissed in court as childish.

The site contained a description of her "likes," which included "blood, pain, girls, guys, my school ... Yep ... Hating people ... my cat, 3 of my friends, rain, darkness, thunder ... fire, my bedroom, sex ... Despite quitting, i like drugs ... cemeteries, knives, the beaches, music. I LIVE for music."

Under "dislikes," she included "three guys who are assholes and whom I have to testify against ... And courtrooms."

The girl had told the jury, though, that her boyfriend's talk of vampires was a turn-off and a reason she wanted to break it off. The boyfriend was one of three teens accused of murder in the death of an east-end Toronto boy.

She said she thought the vampire talk was immature and silly, even by the liberal standards of the arts school she attended, where many students dressed in the boy's all-black ''goth'' style. Coupled with her friends' distaste for this boyfriend, who went to a different school and is a year older, the vampire talk was enough reason for her to think about ending the brief relationship, she told the jury.

But she never told him to stop the vampire talk, or that she found it offensive, she testified. She thought he was just showing off.

"I couldn't see into the future and see what kind of importance that would have,'' she said. That would come later, when she recorded him and two friends boasting on the day of the murder about their plans to kill 12-year-old Johnathan and his entire family.

The girl also posted entries in an online journal on the case.

She describes the testimony of her ex-boyfriend, who is one of the accused, as "hilarious bullshit."

After a tough cross-examination by defence lawyer David McCaskill, she derides him online as "Mr. Bigasskill." He "was such a douche," she wrote on Jan. 24, her last day on the witness stand, when Mr. McCaskill claimed she had a sexual interest in vampirism and was excited by her former boyfriend's boasting about killing people. "I wanted to smack him so fucking hard."
