Just read this finally. First thought that came to mind was that these 2 contradict each other. you Say" if yuo worked your ass off to become rich then you earned it, you keep it" but now yuo are taking away their golf courses? So are yuo saying there will be boundaries then with what they can do with their money?

hmm, i guess i missed the death penalty one

you are justified for the war, well isnt the exact reason why we are there are becasue of the atrocities committed upom their people, as well as ours, under Saddam Hussein? (eg exeuctions during dinners, soccer games) etc.

wouldnt this 'devils island' type prison just bring us down to their level?

and the majority of murders arent commmited Richard Ramirez 'i love to kill' style. but are rather, acts of passion. imagine walking into your house seeing a man raping your daughter, wouldnt that drive you to kill him? and im assuming, on you and the bulk of people here that you really dont want to kill someone. but in this situation wouldnt your judgement be skewed?

how about the fact that the bulk of people who do harm to others, were often times in their childhood harmed as well. again, this isnt justification but this reallly can fuck someone up. how about people with mental illnesses? yes, i think ramirez deserves to die and/or suffer but not all murderers are like that.. a lot of them were just normal joes like the rest of us until something fuced em up for a moment.

oh, just a quick question...do they really give the death penalty to the crimes of passion one? the example you gave, if you saw your daughter getting raped, couldn't they plead momentary insanity and not get the death penalty?

If I came home to find my daughter/wife/mother/grandmother (Whoever!) getting raped, that rapist would be one dead mothefucker. That's why I have 2 guns in my house. One in the bedroom (In case someone tries to break in while I'm sleeping or something.) and one near the side door that I use to go in and out. (That one is put there exactly for situations like this.)

On a similar crimes of passion note, if I walked in on a guy fucking my wife (I'm not married yet, I'm speaking hypothetically here.) and she was into it (ie: having an affair) then I'd be getting charged with a double homicide because both of those fucks would take one in the skull.

I would certainly be momentarily insane with rage, but the fact that I keep a gun near the door (Not to mention discussing it in this thread) would probably be enough to convince the jury that I wasn't crazy. In fact they might even try to call it premeditated, (which it certainly wouldn't be.)

That's too bad. If the time comes that I ever have to make that decision (Hopefully never.) There wouldn't be any decision at all except whether to hide the bodies or call the cops.

dunno if anyone else answered this, but we covered this exact thing in class.

there are degrees, 1st and 2nd. 1st requires malice and aforethought, malice which is a given and aforethought showing thought.

2nd is this exactly, passion. there was probably a second of thuoght before the action. MUCH different between someone plotting something and the courts recognize this

momentary insanity would rarely apply here, but thats like in cases of post partum and such..

NOW there are ALWAYS exceptions eg crime of passion and u massacre 40 people? ... seee.....
