The movie has to have premiered in the previous year. So this years Oscars are in 2008 but the movies have to have played in 2007. They also have to be at least 40 minutes long, been in 35mm or 70mm and played in an L.A. theatre for 7 days straight. Then the Academy votes for their top 5 in each category which determines the nominees. After the nominees are announced the academy votes on their favourites out of that top 5 to determine the winner.
